Terms of Service

The agreement between you and us when you use Elsewhere.

Effective

1. Who we are

Elsewhere is made by Don't Stop LLC ("we" and "us"). These terms cover the website, the apps, and the service behind them. By creating an account or using the apps, you agree to them. Our Privacy Policy explains what we collect and why.

2. Your account

You need to be at least 13 to have an account, and an adult to subscribe. Keep your email address current, since it's how you sign in.

You're responsible for the devices signed in to your account. If one is lost or you don't recognize it, sign it out from your account page.

3. Using Elsewhere

Use Elsewhere only to reach computers you own or have permission to use. You agree not to:

  • Reach a computer without the permission of the person it belongs to, or watch someone without their knowledge.
  • Use Elsewhere to break the law, or to send malware, spam, or anything you don't have the right to share.
  • Get around a limit we've set, such as a plan or the relay's allowance, or interfere with the service or other people's use of it.
  • Copy, resell, or reverse engineer the apps or the service, except where the law allows it.

4. Your subscription

Elsewhere is one plan at $20 a month, plus any tax, and covers every device on your account. A new account can start a 7-day free trial once. If you don't cancel before the trial ends, the subscription starts and renews each month until you cancel.

Cancel any time: on your account page if you subscribed on the website, or in your Apple account's subscriptions if you subscribed in the App Store. You keep access until the end of the period you paid for. We don't refund partial months, except where the law requires it. App Store refunds are handled by Apple.

If the price changes, we'll email you at least 30 days before it applies to you, and you can cancel before then.

5. The apps

We give you a personal, non-transferable license to install and use the apps on your devices while you have an account. The apps update themselves so they stay compatible and secure.

Some features need the apps' permissions on your computer, such as Screen Recording and Accessibility on a Mac. You can turn them off at any time in your computer's settings, and the features that need them stop.

6. Your content

What's on your screens is yours. Sessions run encrypted between your devices, so we can't see them. You're responsible for what you do in a session, and for having the right to see and use what's on the computers you reach.

7. If you get the iPhone or iPad app from the App Store

These terms are between you and us, not Apple. Apple isn't responsible for the app, its support, or any claim about it, including product liability, legal compliance, and intellectual property claims. If the app doesn't work as promised, you can tell Apple, and Apple may refund what you paid for it. Apple has no other warranty obligation. Apple and its subsidiaries can enforce these terms against you.

8. Changes and ending

We may change Elsewhere, including adding and removing features. We may change these terms too; if a change matters, we'll email you before it takes effect, and continuing to use Elsewhere after that means you accept it.

You can stop at any time by deleting your account. We may suspend or close an account that breaks these terms, and will tell you why unless the law or someone's safety prevents it.

9. No guarantees

We work hard to keep Elsewhere reliable, but it's provided as is. To the extent the law allows, we don't promise it will always be available, never fail, or suit a particular purpose. A computer can be offline, asleep, or on a network that blocks it, and then it can't be reached.

10. Limits on liability

To the extent the law allows, we aren't liable for indirect, incidental, or consequential losses, such as lost data, profits, or work. Our total liability for any claim about Elsewhere is limited to what you paid us in the 12 months before it, or $50 if that's more.

If someone makes a claim against us because of how you used Elsewhere in breach of these terms, you agree to cover our reasonable costs of it.

Some places don't allow these limits, and then they apply only as far as the law permits.

11. Governing law

Illinois law governs these terms, without regard to its conflict of laws rules. Any dispute goes to the state or federal courts in Illinois, and you and we agree to their jurisdiction. If you live where the law gives you the right to bring a claim at home, you keep that right.

If part of these terms can't be enforced, the rest still applies. If we don't enforce a part, we haven't given up the right to later.
